The Alabama Regulations 2002-2003 book states the following concerning blue back herring:

Section 220-2.26, Item (6)- It shall be unlawful to possess, sell, offer for sale, import, or release any of the following fish: chinese perch, all snakeheads, all mud carp, or blue back herring.

Doesn't specifically say dead or alive. Incidents on High Rock lake with wildlife officers over cast nets without special permits has proven that their individual interpretations of the rule book can stand up in court. It would be a good idea for anyone using dead bluebacks to have the e-mail sent from the ADNR in hand, just in case.
